FROM EXECUTIVE DECREE TO CODIFIED INSTITUTION: THE LEGAL EXPERIMENT AS A TOOL OF REGULATORY LEARNING IN UZBEKISTAN

Abstract

Legislatures facing uncertainty about a proposed rule's effects have traditionally chosen between two imperfect options: enacting it on the strength of a forecast and correcting it later, or delaying legislation until the evidence is in. The first risks regulating an imagined reality rather than the real one; the second leaves a vacuum that private practice fills on its own terms, often in ways later hard to reverse. A legal experiment the temporary, deliberately bounded application of a rule to a defined territory or circle of persons, coupled with an obligation to evaluate the result offers a third path: it builds the correction into the rule itself rather than asking the legislator to be right the first time. Uzbekistan is an unusually clear case of this device evolving from a one -off administrative measure into a general legal institution within a period short enough to observe directly.
